Companies House information sharing application guidance
Companies House have provided further information on how insolvency practitioners (IPs) are able to request non-public information under measures introduced by the Economic Crime and Corporate Transparency Act 2023.
Earlier this year, we explained about new rights which have been given to the Registrar of Companies to allow the sharing of non-public information with insolvency practitioners (IPs).
The Information Sharing (Disclosure by the Registrar) Regulations 2024 provide that non-public information can be shared with specified persons - IPs, The Official Receiver, The Accountant in Bankruptcy, Trustees in sequestration and protected trust deeds in Scotland and Judicial factors in Scotland.
The disclosure of information can only be made where it’s for certain specified purposes. This includes assisting the specified person to make or determine whether to make an application to the court for an order relating to fraudulent and wrongful trading, transactions at an undervalue and preferences, extortionate credit transactions and gratuitous alienations under insolvency provisions across the UK.
To make a request, insolvency practitioners should complete an IP request form (see below) and once completed email it to the Law Enforcement Liaison inbox:
Contact
Information that can be requested includes the following data:
