Data protection - Key issues
This course sets out an overview of some of the more complex provisions of the Data Protection Act 1998 and the Privacy and Electronic Communications Regulations 2003 with particular emphasis on direct marketing and data subject access requests. It also explains how these areas will be affected by the General Data Protection Regulation and what steps need to be taken in the light of this.

- understand the principles that apply to the making of data subject access requests and also how a data controller can respond to these requests in an effective and pragmatic way
- have an awareness of recent cases dealing with the exemptions that relate to disclosure under a data subject access request
- be familiar with the principles that apply to direct marketing with particular emphasis on the correct usage of opt-out and opt-in tick boxes
- be able to describe how these issues will be affected by the General Data Protection Regulation and recognise what needs to be done about this

Keith Markham qualified as a Solicitor in 2001 and now works as a freelance presenter of training courses.
Initially working in private practice, in 2004 he moved in-house at the BGL Group, a major insurance intermediary that numbers Budget and comparethemarket.com among its brands. During his time there Keith advised on and conducted contract negotiations of a complex nature, often with major blue chip companies. He also advised extensively on data protection and consumer regulations as well as e-commerce and website related issues.
Keith joined BPP in 2007 and worked as both an in-house lawyer dealing with commercial contracts and also as a presenter of training courses before ultimately deciding to specialise in delivering training and becoming a freelancer in 2009.
Drawing on his considerable experience Keith has designed and delivered a wide variety of training for BPP and other providers as well as for his own clients in the commercial law field. In particular he teaches topics relating to commercial contracts, data protection and e-commerce to lawyers and non-lawyers alike.
